“The air in Munich is already getting better,” says Brannekamper. In the third quarter of last year, the critical values ​​of nitrogen oxide were not exceeded at any measurement point in the city. Previously, only Tegernseer Landstraße and Landshuter Allee had exceeded the limit of 40 micrograms per cubic meter of air set at European level, albeit marginally. Brannekämper also argues that air quality during the lockdown hardly improved significantly when fewer cars were shown to be in the city. This shows that cars do not cause bad values ​​per se.

Diesel driving ban in Munich: critics are confident that the courts will uphold the claim

The diesel ban was made necessary because the German Environmental Aid (DUH) had sued and won several cases. Initially, the Free State was responsible for complying with the limit values ​​in Munich using the so-called clean air plan. But in mid-2021, the state government passed responsibility to the city. The leadership of the city council then resolved the compromise with the DUH. Now the courts have to decide again.

Critics of the ban are encouraged by their legal counsel. The lawyer Claus-Peter Martens had already achieved success in Berlin. In the Federal Capital, a traffic ban has been in force since July 2019 on eight sections of the road. Martens had sued against this with two clients and they were right. In 2021, the Senate lifted the first four driving bans and the rest will be lifted in the summer.
